After the untimely demise of MODOX via Moxie's lawsuit, Big Jim Barry set up Herb-O Phosa as the next generation of soft drink. It was marketed as both "A Sweet Bitter Nerve Drink" and "A True Fruit Phosphate Drink." The new company was simply called Herb-O Phosa Company and manufactured and bottled at 233-237 West Exchange St. in Providence, RI. Herb-O Phosa was marketed just like MODOX with Indian theme and the "Nerve Drink" motto. A new gimmick to keep sales repeating by saving the bottle caps for redemption for premiums was instituted. Again, Phosa was sold at drug stores and soda fountains just like it's predecessor, as well as by the bottle direct to the consumer.
